1. Purpose
These terms govern the sale of Pourboire.io subscriptions and services: provision of a digital tipping service (QR codes, card collection, payout to servers) and, where applicable, custom products (QR stands, badges, textiles).

3. Businesses and consumers
The service is intended primarily for hospitality professionals (restaurant owners, managers). A professional who subscribes declares that they are acting within their business and have the authority to commit the establishment.
4. Subscriptions, prices and billing
Subscriptions are offered at the prices shown on the Pricing page at the time of subscription. They are billed monthly, in advance, by card via our payment provider. Prices are shown excluding tax; applicable VAT is added to the invoice.
The 30-day free trial is not billed. At the end of the trial, the subscription is billed unless cancelled before the end of the trial period.
Collected tips are paid to the beneficiary servers. The platform takes no commission on tips, whatever the plan. Payment provider fees are paid by the establishment: they are not deducted from the amount paid to servers and appear on the payout statement.
5. Duration and cancellation
The subscription has no fixed term. It can be cancelled at any time from the manager area; cancellation takes effect at the end of the period already billed. No pro-rata refund is made for the current period.
6. Right of withdrawal
Consumer customers have 14 days to withdraw, unless they expressly requested the service to start before the end of that period, in which case they waive withdrawal for the part already performed.
Under article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the customer's specifications or clearly personalised (textiles, badges and stands printed with their name or logo).
7. Custom products
Any order of a custom product requires providing a logo or a placement indication. The customer guarantees they hold the rights to the elements provided and grants the seller the right to reproduce them solely to fulfil the order. A proof is provided before production starts.
Production and delivery times are stated at the time of order. In the event of a printing defect attributable to the seller, the product is reprinted free of charge.
8. Service access
The service is available 24/7, subject to maintenance operations and unavailability of our providers (hosting, payment). The seller undertakes to use reasonable means to restore the service as quickly as possible.
9. Customer obligations
The customer provides accurate information, protects their credentials and complies with the regulations applicable to tips. They must inform their team and customers of the use of the device.
10. Liability
The seller's liability can only be engaged in case of proven fault and is limited to the sums actually paid over the last twelve months. The seller is not liable for unavailability of the end customer's mobile network or for handling errors on their device.
11. Personal data
Data is processed in accordance with the privacy policy available on the site. The customer has the right to access, rectify and erase data by writing to [email protected].
12. Complaints and mediation
Any complaint must be addressed to [email protected]. Consumer customers may use a consumer mediator free of charge. For professionals, the commercial court of the seller's registered office has jurisdiction.
13. Governing law
These terms are governed by French law. In the event of difficulty, the parties will seek an amicable solution before any legal action.
